How to Rent a House In Turkey?

If you want to rent a house in Turkey, you must first find the house that meets your criteria and make a rent agreement. The most frequently used sites to access house advertisements are www.sahibinden.com and www.hepsiemlak.com.


The rent agreement can be made directly with the landlord or through a real estate agent. A brokers fee is also required to be paid for the real estate in rentals made through a real estate agent. Although the fee to be received by the real estate agent varies according to the contract made between the parties, in practice, a rental fee or an intermediary fee of around 15% of the average annual rental price is usually requested from the tenant.


Since the rental agreement will determine the rights of the landlord and the tenant, it is important to include the following issues in the rental agreement prepared when renting a house.

  • Full address of the rented house

  • Type of rented item

  • Name, surname/title of the rentor

  • T.C. identification number and tax number

  • Residence address of the rentor

  • Tenant's name, surname/title

  • Tenant's T.C. identification number and tax number

  • Tenant's residential address

  • Tenant's workplace address

  • One month's rent amount

  • One year rent amount

  • How the rent will be paid

  • Rental period

  • Rental start date

  • Current status of the rented item

  • What will the rented item be used for

  • Compulsory Earthquake Insurance (DASK) policy


When renting a house to foreigners in Turkey, the tenant's T.C. Identity number information for foreigners should be entered in the ID number information section.


The identification number for foreigners can be obtained from the Foreign Identity Number Inquiry page of the Ministry of Interior, General Directorate of Population and Citizenship Affairs. If the foreign national who will be renting the house does not have a foreign identity number, information about the application can be obtained from the Istanbul Governorship Foreign Identity Number Transactions page.


What are the Rights of the Tenant in Case the Leased Property Is Not In Compliance With The Contract?

The lessor has to keep the leased thing in accordance with the rent contract throughout the lease. If the leased thing is not in accordance with the rent contract at the beginning of the contract or during the contract, the lessee may request the lessor to eliminate the defects or to make a proportional reduction from the rental price or to repair the damage. However, the request for compensation does not prevent the use of other optional rights. In addition, the lessee has the right to terminate the contract if the leased property is in breach of the contract to a significant extent.


Should the Tenant Leave the House at the End of the Rental Agreement Period?

In accordance with Turkish legislation, a rental agreement can be concluded for a certain and undetermined period. For residential and roofed workplace rentals, the contract is deemed to be extended for one year under the same conditions, unless the tenant notifies at least fifteen days before the end of the fixed-term contracts. The lessor cannot terminate the contract based on the expiry of the contract period. However, at the end of the ten-year extension period, that is, at the end of the 11th year from the starting date of the rental agreement, the lessor may terminate the agreement without giving any reason, provided that it gives a notice at least three months before the end of each extension year following this period.


If the lessee undertakes to evacuate the rented property in writing on a certain date, after the delivery of the leased property, the lessor may terminate the contract. For this reason, even if requested by the lessor when signing the lease agreement, a document containing an eviction commitment should not be signed.


What Will Happen if the Rent is not Paid?

If the rent is not paid, the lessor has the right to terminate the rental agreement. However, if the lessee has caused two justified warnings in writing because he has not paid the rent for a period exceeding one rental year, the lessor may terminate the lease agreement. In this context, care should be taken to pay the rent regularly.


Can the Lessor Terminate the Contract Due to Need?

In the event that the lessor, his spouse, descendants, descendants or other dependents as per the law, or the new owner of the estate, his spouse, descendants, descendants or dependents by law have a housing need, the rent agreement may be terminated by the new purchaser.
